Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Engram ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. Engram is provided by Engram Computer ("we", "us", "our").

2. Description of Service

Engram is a macOS application that provides screen recording, screenshot capture, clipboard history management, and AI-powered recording intelligence. The App processes data locally on your device. An optional MCP (Model Context Protocol) server allows AI agents to interact with the App's capabilities.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Engram on macOS devices you own or control, subject to these Terms. You may not:

  • Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law.
  • Redistribute, sublicense, or resell the App or any part of it.
  • Use the App for any unlawful purpose, including recording others without their consent where required by law.
  • Remove or alter any proprietary notices or labels on the App.

4. Your Content

You retain all rights to content you create using Engram, including recordings, screenshots, and clipboard data. We do not claim ownership over your content. Since all data is stored locally on your device, you are responsible for backing up and securing your content.

5. Purchases & Payments

Engram is distributed through the Mac App Store. All purchases and subscriptions are processed by Apple and subject to Apple's terms and conditions. Refunds are handled by Apple in accordance with their refund policy. You can manage your subscription through your Apple ID account settings.

6. Recording & Privacy Compliance

You are solely responsible for complying with all applicable laws regarding screen recording, audio recording, and data capture in your jurisdiction. Many jurisdictions require consent from all parties before recording conversations. Engram provides the tools — legal compliance is your responsibility.

7. AI & MCP Integration

Engram's MCP server allows third-party AI agents to interact with the App on your behalf. You are responsible for:

  • Understanding what data you expose to connected AI agents.
  • Configuring appropriate access controls for MCP connections.
  • Any actions taken by AI agents through the MCP interface on your machine.

We are not responsible for the behavior of third-party AI agents that connect to Engram via MCP.

8. Disclaimer of Warranties

Engram is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. On-device AI processing (transcription, OCR, chapter detection) is provided for convenience and may contain errors.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of Engram. This includes but is not limited to loss of data, loss of recordings, or unauthorized access to your locally stored content. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

10. Termination

We may terminate or suspend your license to use Engram at any time if you violate these Terms. Upon termination, you must cease all use of the App. Your locally stored data remains on your device and is not affected by license termination.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will update the "Last updated" date at the top of this page when changes are made.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Engram Computer operates, without regard to conflict of law principles.
